First global standard for ship hull cleaning essential for marine ecosystems

BIMCO, the world’s largest shipping association, has moved a step closer to finishing a global set of guidelines needed to protect the marine environment from invasive species and reduce CO2 emissions. Currently, there is no common global standard for cleaning ships’ hulls to avoid transferring invasive aquatic species, nor for the potentially damaging debris washed off in the process.

Following the ultimate Sales & Purchase peak in 2007 where vessels valued at USD 40 billion were traded, the last 4 months of 2008 and most of 2009 were comparable sinkholes. Now the secondhand markets are on the rise again and on course to hit a total sales value of USD 20 billion for the full year comprising the three main segments, dry bulkers, tankers and container ships. This represent a rise in sales value equal to almost 60% y-o-y, up from USD 12.7 billion in 2009. With only 10% more ships traded – the secondhand value of the fleets have considerably surged.

First ever standard contract for autonomous ship operation underway

BIMCO is adapting the currently used SHIPMAN 2009 agreement for use with autonomous ships, but the lack of actual autonomous ships currently in operation will mean ongoing adjustments as the industry forges ahead with its pioneering projects. Publication of the first version is expected in 2021.

For the benefit of its members, BIMCO has made a series of agreements with 15 national customs authorities (Belgium, Canada, Cyprus, Denmark, Finland, France, Germany, Greece, Ireland, Italy, the Netherlands, Norway, Sweden, the United Kingdom and the United States)- Customs Co-operation Agreements (CCAs)- as a means of mitigating delays and costs resulting from the discovery of drugs aboard a member vessel.

BIMCO standard ship repair contracts overhauled

BIMCO has revised and updated its two standard ship repair contracts: REPAIRCON, which is for major work at a repair yard; and MINREPCON, which is for minor repair work that can be done by contractors when a ship is in port.

FONASBA Standard Liner and General Agency Agreement

The Standard Liner and General Agency Agreement was published by FONASBA (the Federation of National Associations of Ship Brokers and Agents) and approved by BIMCO in 2001. It is a contract between the liner principal and its agent and governs, for example, the obligations of and payments to the agent. BIMCO embarks on new standard for “quiet enjoyment”

A newly set-up BIMCO drafting team involving a cross-section of shipowners, charterers, financing and leasing institutions and private practice lawyers from Asia, Europe and the US began work this week to develop a standard letter of quiet enjoyment (LQE) for use in long term charter and leasing structure financings.
