BIMCO’s Documentary Committee has agreed to carry out a major overhaul of the Dispute Resolution Clause with the aim to shorten and simplify what has become BIMCO’s longest standard clause.

RECYCLECON is a standard contract for the sale of ships for recycling in a safe and environmentally sound manner. The contract incorporates many of the requirements of the Hong Kong International Convention for the Safe and Environmentally Sound Recycling of Ships, 2009 (the Hong Kong Convention) such as the Inventory of Hazardous Materials and the Ship Recycling Plan. Following Pakistan's recent accession to the Hong Kong International Convention for the Safe and Environmentally Sound Recycling of Ships (HKC), all major ship recycling states, including Türkiye, India, Bangladesh, and Pakistan, have become parties to the IMO's HKC.

Fergus Gifford is Director of Newbuilding and Sale & Purchase at Arrow in Tokyo. After seven years at Arrow in London and Hong Kong, he moved to Tokyo in August 2019. Born in London, he studied at Edinburgh University and has spent half his life in Asia, dividing his time between Tokyo, Kobe and Hong Kong. Arrow Shipping Group was founded in 1991 and over the last 30+ years has expanded to offices in 15 countries. As well as Sale and Purchase and Newbuilding, it offers Chartering, Derivatives, Research and Valuation services.

Under the presidency of Mrs Sadan Kaptanoglu, the BIMCO Board of Directors has approved the nomination of Mr Nikolaus H. Schües, CEO of Reederei F. Laeisz (Germany) to stand for election as the next President Designate of BIMCO in 2021, succeeding Mrs Sabrina Chao, Chairman of Wah Kwong Shipping Holdings Limited (Hong Kong).

She has particular interest and experience in locating and securing the proceeds of fraud, obtaining injunctions and disclosure orders, and tracing assets. Elizabeth also practices in the maritime sector, with experience in arrest, judicial sale, jurisdictional challenges, limitation of liability, and shipping insolvencies. In addition, she assists clients to manage litigation in other jurisdictions. Elizabeth is admitted to practice as a solicitor in Australia, Hong Kong, and England and Wales. She joined Stephenson Harwood in 2016 from another international law firm. Elizabeth has been based in Hong Kong since 2008.
