Programme and links

BIMCO's masterclass on marine carriage contracts, liabilities and cargo claims examines in detail specific issues which arise when goods are damaged, lost or delayed during transit. This masterclass will focus on the legal liabilities of carriers and the practical issues which arise when claims are made against ships, including the mechanics of pursuing and defending cargo claims.

The course comprises presentations on various relevant aspects and two case studies which will consider these issues in the context of common day-to-day scenarios.

  • overview of marine cargo claims
  • principal causes of cargo claims
  • the significance of transport documents to the claims process
  • introduction to the international conventions for the carriage of goods by sea
  • the carrier’s duty to provide a seaworthy ship and a ship fit to carry the cargo
  • the carrier’s duty of care in relation to the care of cargo
  • the carrier’s defences
  • practical issues: notice of loss, evidence, surveyors, burden of proof, quantifying losses, currency of claims
  • jurisdiction and security requirements
  • cargo claims under multimodal carriage contracts
  • dangerous cargoes
  • relevant insurance issues
  • case studies are integrated in the programme and an optional assessment is scheduled at the end of the course.

Richard Williams was a partner with Ince & Co for 25 years and was chairman of the firm’s dry shipping business group specialising in carriage of goods, charter parties and P&I issues. Professor Soyer is the Director of the Institute of International Shipping and Trade Law at Swansea University (www.swansea.ac.uk/law/istl).
