Day 1: Digitalisation, cyber risks and relevant legal frameworks (90 minutes)

Introduction: This session provides a holistic understanding of how digital transformation is reshaping the shipping industry, a practical perspective on the challenges and opportunities of digitalisation in maritime operations and a comprehensive understanding of the legal and regulatory landscape governing cyber risks in shipping.

  • The digital transformation of shipping: How digital technologies drive efficiency, innovation, and sustainability in maritime operations and the impact of digitalisation on the global supply chain
  • Emerging cyber risks: Types of cyber threats: ransomware, phishing, spoofing, attacks on operational technology and navigation systems and real-world cases of cyber incidents affecting ships, ports and supply chains
  • Risk management and best practices: Guidelines for assessing and mitigating cyber risks and robust cyber security practices, including the Cyber Security Workbook for On Board Ship Use
  • The human element: Addressing digital disparity, the need for continuous training and integration of the human factor into digital transformation initiatives
  • Regulatory and legal frameworks: Overview of international regulations (IMO guidelines, integration of cyber risk management into Safety Management Systems), Implications of the EU NIS2 Directive and other regional requirements, legal considerations under international conventions when cyber incidents occur.

Day 2: Contractual allocation of risks and liabilities in a digitalised shipping industry (90 minutes)

Introduction: Building on Day 1, this session provides a comprehensive overview of contractual risk allocation and how insurance products are evolving to address the new challenges that come with increased connectivity and automation.

  • Content Overview:
    Allocation of risks and responsibilities in charter parties and related contracts, including indemnities and how cyber risks can trigger or limit liabilities under bills of lading and sale contracts.
  • BIMCO Cyber Security Clause 2019: How the clause allocates cyber related responsibilities between contracting parties, including requirements for maintaining appropriate cyber security measures, documenting and responding to breaches and ensuring that agents and subcontractors comply with agreed standards
  • Insurance and financial safeguards: How insurance products are adapting to cover cyber-related risks and what shipowners and operators need to demonstrate for coverage and resilience.
  • Practical guidance: Steps to ensure compliance and minimise legal/financial exposure, examples of claims and lessons learned.
