Overview

Voyage chartering is a diversified business and not regulated by any compulsory international conventions. The carrier agrees with a charterer to provide a vessel - ready to carry an agreed cargo - in exchange for payment of freight. This course highlights problem areas and discusses ways for the parties to reallocate risk. It also offers an overview of the relevant legal principles of voyage chartering.

What will you learn?

Some of the topics the course will cover are:

  • The nature of a voyage charters
  • The relationship between voyage charters and other trading and carriage contracts
  • The owners and charters duties
  • The nature and purpose of liens on cargo and on sub-freights
  • Defences to liability

Case Studies

The crew of a tanker finds themselves in the middle of the devastation of a huge refinery. During the loading operations a powerful earthquake strikes, destroying or damaging infrastructure in and around the port. With only around half the cargo onboard, the tanker disconnects mooring lines and hoses and drop anchor, awaiting further instructions from the charterers. After a period at anchor, the vessel departs. Subsequently, the owners submit a claim for dead freight and demurrage. Will the claim succeed? And how much demurrage (if any) is the owner entitled to receive?

In the case studies, you will work in small groups to consider scenarios and a range of problems that may arise. The cases will form a basis for dialogue and will help the participants understand the relevant legal principles, practise and reallocation of risk.

Why participate?

While there are basic obligations of each party to the voyage charters, the charters are not regulated by any compulsory international conventions, and the principle of freedom of contract is absolute.

You will be taught by hand-picked industry experts who have built a career out of solving complicated voyage chartering issues. The combination of theory, discussion and casework will make the complexity of voyage chartering clear and manageable. The teachers will share valuable experiences and point participants towards practical solutions that can be used on the job. The course will also facilitate networking between international shipping peers and enable long-term relationships between the participants.

The seminar is aimed at all practitioners involved in maritime transportation, who wish to boost their expert knowledge and become proficient in voyage chartering, both for dry and wet cargoes.

How will this course help you with your professional development?

The course will equip you with a much deeper understanding of the fundamental challenges related to voyage chartering and provide you with a balanced understanding of the relevant legal principles and practise. The course will help you identify the potential challenges in advance and enable you to ask the right questions to the parties involved. This will help you to understand and explain your own risks and exposure, and allow you to discuss issues surrounding allocation of risks and the legal relationships with your superiors, P&I club or legal counsel.
