Overview

The SUPPLYTIME Masterclass Online is a series of 10 online sessions examining different versions of the SUPPLYTIME contract. During the sessions, we will also examine the practical and legal differences using SUPPLYTIME for other purposes than OSV/AHTS. Each session will run for 90 minutes.

DISPUTES UNDER SUPPLYIME 2017 - THE “ATLANTIC TONJER”

The “Atlantic Tonjer” [2019] EWHC 1213 (Comm) is the first reported judgment on SUPPLYTIME 2017. The case was important for several reasons. A dispute arose under clause 12(e), the payments provision, which requires Charterers to notify Owners by no later than the due date of an invoice, if they reasonably believe that the invoice is incorrect. However, the case was not only an opportunity to clarify the effect of changes made to this specific clause, but also a valuable insight into the judicial interpretation of the overall changes made to SUPPLYTIME 2017. The two trainers, Tony Concagh and Nick Kazaz were both involved in the “Atlantic Tonjer” case, but on different sides.

Using the knowledge from the “Atlantic Tonjer” sessions 9-10 will bring together issues discussed in the previous sessions to create a toolkit for both owners and charterers. These toolkits can serve as a future personal and individual checklist for each participant when using the SUPPLUTIME form.

SUPPLYTIME is the benchmark for offshore support vessel agreements – and the industry’s contract of choice. It has also been widely adopted by other sectors looking for a contract offering a comprehensive knock-for-knock framework. This course will assist you in identifying how the form works when being used for a wide variety of tasks, thereby helping you to understand and explain your own risks and exposure. You will be able to discuss issues, such as unused maintenance days at the conclusion of the charter, lay-up provisions and the revised knock-for knock provisions with your superiors, P&I club or legal counsel.

Course certification

Participants will be given an option of taking a final assessment (one-hour open-book test) at the end of the course, and Certificate of Achievement will be issued with a grade (distinction, merit or pass). Those not taking the assessment will receive a Certificate of Attendance.

BIMCO issues electronic course files as an Adobe PDF file enabling you to make personal notes. All documentation and presentations will be in English. Course access details will be provided once the registration is completed.
