Technical and regulatory aspects of the 2020 global fuel sulphur limit are major concerns to the industry ahead of 1 January 2020. The course focuses on all aspects including bunker clauses.

  • Overview of the BIMCO suite of fuel clauses and how they can be used going forward
  • Working with the 2020 Fuel Transition Clause for Time Charter Parties
  • Working with the Marine Fuel Sulphur Content Clause for Charter Parties
  • Workshop on installation of scrubbers and the possible contractual issues leading to disputes
  • Overview of the possible effects of MARPOL VI regulations 14 and 18
  • Supply and demand for fuels after 1 January 2020

Case studies

If owners have fitted the scrubber and shared the costs with time charterers, should charterers have any liability if the scrubber breaks down? Does MARPOL Annex VI permit the ship to continue trading if the scrubber breaks down?

Installation of scrubbers may cause a range of unforeseen contractual consequences, the results of which can be difficult to predict both for owners and charterers. What issues can arise? In a short workshop, all participants will work in groups to answer one question per group. The result of all the workshops we conduct worldwide will be shared between all the participants.

These clauses provide a commercial approach to apportionment of liability for some of the key issues arising out of the change in regulation.

Course certification

A 60 minute open book assessment is part of the course, the purpose is to ensure that the participants use information at their disposal to solve problems in a practical way. A BIMCO certificate will be issued. Case studies.
