Over the past few months, the BIMCO Ship Recycling Alliance has drafted a paper they will submit to the Basel COP. The Alliance consists of members of both the global shipping and ship recycling industries.

The webinar will examine the conflicting requirements of the two Conventions and discuss solutions for harmonising their approaches.
The aim of the webinar is to explain the interplay between the Basel Convention (BC) and the Hong Kong Convention (HKC), and the fact that this interplay will result in significant legal and practical challenges once HKC enters into force. After HKC’s entry into force in June 2025, ships that are fully compliant to the regulations of HKC will risk being detained in the port of departure of their final voyage.
The HKC, along with its guidelines, represents a significant advancement in harmonising global standards. The HKC not only addresses the gaps identified in the BC PIC procedure but also includes an improved reporting system for ships destined for dismantling. In addition, it not only addresses end-of-life ships but will apply throughout ships’ entire lifespan.
The webinar will elaborate why Article 11 of the BC, as proposed by the IMO provisional guidance, is not a viable solution for ship recycling. Relying on Article 11 will perpetuate inconsistencies and will at best will create a geographic patchwork of regulatory requirements and disrupt the establishment of a universally accepted framework for ship recycling.
Legal uncertainties and operational challenges need resolution to harmonise the regulations, ensuring effective enforcement and environmentally sound ship recycling practices.
