Restrictions & Sanctions

European Union Regulations on Union of Myanmar

Council Common Position 1996/635/CFSP of 28 October 1996 reaffirmed an embargo on arms, munitions and military equipment and the suspension of certain non humanitarian aid or development programmes. In addition it introduced a ban on entry visas for certain named persons.

Council Regulation (EC) No 1081/2000 of 22 May 2000 introduced a prohibition on the sale, supply and export to Myanmar of equipment which might be used for internal repression or terrorism and the freezing the funds of certain persons related to important governmental functions in that country.

These sanctions were subsequently extended, amended and broadened under numerous Council Regulations.

Council Regulation (EC) No 194/2008 of 25 February 2008 provided a new text containing all the relevant provisions, as amended for the sake of clarity. The sanctions included:

  • Ban on certain import goods (Round logs, timber, timber products, coal, certain metals, precious and semi-precious stones - Annex I)
  • Ban on export equipment which might be used for internal repression (Arms, munitions, military equipment, certain vehicles, etc - Annex II)
  • Restrictions on exports of equipment used in industries targeted by the import ban (Annex III)
  • Ban on the provision of certain services (incl. financing and financial assistance related to equipment used in industries targeted by the import ban)
  • Freezing of funds and economic resources (Annex VI), together with the banning of certain investment

Lists of targeted persons, entities and bodies were provided under Annexes V, VI and VII.

These Annexes were last amended by the publication of Commission Implementing Regulation (EU) No 383/2011 of 18 April 2011. Annexes V, VI and VII were replaced by Annexes I, II and III to this Regulation.

Council Decision 2010/232/CFSP of 26 April 2010 renewed / amended the restrictive measures against Myanmar.

Council Regulation (EU) No 408/2010 of 11 May 2010 amended Council Regulation (EC) No 194/2008 in light of Council Decision 2010/232/CFSP.

Council Decision 2011/239/CFSP of 12 April 2011 amended Decision 2010/232/CFSP renewing restrictive measures against Myanmar. The ban on certain import goods was amended to the purchase, import or transport from Myanmar into the Union of the following:

(b) gold, tin, iron, copper, tungsten, silver, coal, lead, manganese, nickel and zinc;
(c) precious and semi-precious stones, including diamonds, rubies, sapphires, jade and emeralds.

Council Regulation (EU) No 409/2012 of 14 May 2012 suspended most of the restrictive measures, except the arms embargo and the embargo on equipment which might be used for internal repression, laid down in Council Regulation (EU) No 194/2008 until 30 April 2013 and amended the list of person under Annex VI.

Council Decision 2010/232/CFSP replealed by Council Decision 2013/184/CFSP of 22 April 2013 which lifted all restrictive measures with the exception of the arms embargo and the embargo on equipment which might be used for internal repression.

The provisions of Council Decision 2013/184/CFSP where extended by Council Decision 2014/214/CFSP of 30 April 2014 and Council Decision (CFSP) 2015/666 of 28 April 2015.
