CII Clause for Voyage Charter Parties 2023

On 1 January 2023, the International Maritime Organization’s (IMO’s) Carbon Intensity Indicator (CII) regime under the International Convention for the Prevention of Pollution from Ships (MARPOL) in the form of Resolution MEPC 328(76) (together with associated guidelines) (hereinafter "the MARPOL Carbon Intensity Regulations") entered into effect, applying to ships of more than 5,000 gross tons. The CII Clause for Voyage Charter Parties is broadly in line with the original BIMCO Slow Steaming Clause for Voyage Charter Parties 2012 maintaining some of the wording from that clause and catering specifically for the MARPOL Carbon Intensity Regulations. In essence, this clause enables the parties to agree to an adjustment of the vessel's course and/or speed or RPM in line with specified parameters as a tool to assist the parties in complying with the MARPOL Carbon Intensity Regulations.

Just in Time Arrival Clause for Voyage Charter Parties 2021

The Just in Time Arrival Clause 2021 is for use in voyage charter parties where owners and charterers have agreed to operate a just in time arrival scheme that permits charterers to ask owners to optimise the speed of the ship to arrive at a destination at an agreed time. The clause takes a generic approach so that it can also form part of different vessel and port management schemes around the world. It may also be used together with the BIMCO Port Call Data Exchange Clause 2021 which has been designed to encourage wider application and use of the IMO data model framework for the harmonised exchange of ship/port information.

SERVICECON

SERVICECON is a standard service contract whereby a shipper undertakes to transport a minimum number of containers over an agreed given period. It has been developed to provide a basis for volume carriage in liner trades worldwide. Individual shipments are subject to the contracting carrier’s own bills of lading or sea waybills which are incorporated into the SERVICECON agreement.
