The sanctions landscape for the container trade has grown increasingly complex over the past decade. To provide the container industry with a bespoke contractual solution that addresses the practical and commercial realities of the liner trade BIMCO has developed a Sanctions Clause for Container Vessel Time Charter Parties 2020.
The sanctions landscape has grown increasingly complex. International sanctions regimes are constantly changing with new restrictions being added and new persons and entities being listed. A violation of sanctions restrictions can have severe consequences and in the worst cases can lead to parties being listed as sanctioned parties. Therefore, carefully worded sanctions clauses in contracts of affreightment are vital for internationally trading companies to help them manage and mitigate their sanctions risk and to enable them to continue to do business while remaining compliant with the various sanctions regimes.
From 15 June 2022, international ships arriving in Australia will have to comply with new requirements for managing biofouling. This will include biofouling reporting requirements prior to arriving in Australian territorial seas.
Biofouling is getting increasing attention and pressure for biofouling management is mounting. Therefore, BIMCO is launching a survey to gain insight into how shipowners are managing the topic.
BIMCO has forwarded the results of a biofouling survey to the International Maritime Organization (IMO) to contribute with insight into biofouling practices ahead of the IMO’s revision of the existing guidelines for ships’ biofouling.
The 10th meeting of the IMO Sub-Committee on Pollution Prevention & Response has completed its review of THE 2011 GUIDELINES FOR THE CONTROL AND MANAGEMENT OF SHIPS' BIOFOULING TO MINIMIZE THE TRANSFER OF INVASIVE AQUATIC SPECIES with new guidance to ships on how to best manage biofouling including through performance monitoring, inspection frequencies and in-water cleaning- either proactive or reactive.
