IMO’s HNS Convention now closer to ratification

Overview

The last convention of the international liability and compensation regime for pollution damage from ships is now closer to ratification with the European Parliament’s consent. The consent is to the draft EU Council Decisions authorising member states to ratify the 2010 Protocol to the International Convention on Liability and Compensation for Damage, in connection with the Carriage of Hazardous and Noxious Substances by Sea, 1996.

The European Parliament this week gave its consent to the draft EU Council Decisions authorising member states to ratify or accede to the Protocol of 2010 to the International Convention on Liability and Compensation for Damage in connection with the Carriage of Hazardous and Noxious Substances by Sea, 1996 (2010 HNS Protocol).

With this consent, the EU Council can formally authorise member states to ratify or accede to the convention, which represents the last convention of the international liability and compensation regime for pollution damage.

The shipping industry represented by BIMCO, the European Community Shipowners’ Associations (ECSA) and the International Chamber of Shipping (ICS), is very supportive of the 2010 HNS Protocol and has advocated for its ratification and early entry into force – in the EU led by ECSA.

Once the Council Decisions are adopted, member states that are ready to ratify or accede to the Convention will be able to go ahead with their processes, and this will hopefully encourage other states to follow their example.

A joint statement by BIMCO, ECSA and ICS has been published today as a result of the Parliament’s consent.
