Overhaul for REPAIRCON ship repair contract

Overview

Work has begun on the revision of BIMCO’s Standard Ship Repair Contract, codenamed REPAIRCON.

First published in 2002, REPAIRCON has become an increasingly popular choice for owners in need of repairs to their ship ranging from unscheduled emergency work to larger projects lasting several months. The contract is being updated to ensure it reflects current commercial practice in repair yards and any recent legal developments. In parallel to this project, REPAIRCON’s sister contract, MINREPCON, will also be revamped to widen its appeal. MINREPCON is intended to be used for minor afloat repairs at a commercial berth or anchorage with sub-contractors who would generally would not sign a longer contract, or would use their own terms and conditions.

The drafting team consists of representatives from J. Lauritzen, Stena RoRo, Lisnave, Mills & Co Solicitors and Skuld P&I Club. The first meeting took place at BIMCO House on 19 September 2017.

The drafting team discussed the possibility of adapting REPAIRCON for ship conversions. The preliminary conclusion is that it would be difficult to make REPAIRCON usable for conversion work with just a few additional clauses. It would probably be better to create a standard conversion contract modelled on a newbuilding contract instead. The drafting team plan to explore this issue further at future meetings.
