BIMCO's masterclass on marine carriage contracts, liabilities and cargo claims examines specific issues arising when goods are damaged, lost or delayed during transit.

After a short delay, the bulk carrier Charmy arrives in Egypt with potash from Hamburg. When the ship arrives, the load is 180 tons short and partly wet. The master did protest the quantity of the cargo but did ultimately allow the bill of lading to be signed by the Charterer’s agents “for and on behalf of the master”. The consignee complains and threatens to detain the vessel, but the ship can leave against a P&I Letter of Undertaking.
Does the signature of the bill of lading by the charterers’ agents bind the shipowners as carriers? What is the governing contract between the consignee and the shipowners? Is the security provided to consignee enough to protect their interests? These are some of the questions the participants will try to answer.
In the case studies, you will work in small groups to consider the scenario and a range of problems that arise. The cases will be a focus for dialogue and will help the participants understand the complexities of damaged cargo.
The combination of theory, discussion and casework will make the complexity of cargo claim procedures clear and manageable.
You will be taught by hand-picked industry experts who have built a career out of solving complicated issues related to cargo claims and marine insurance. The teachers will share valuable experiences and point participants towards practical solutions, which can be used on the job.
The course will also facilitate networking between international shipping peers and enable long-term relationships between the participants.
The Masterclass is aimed at all practitioners involved in maritime transportation, who wish to boost their expert knowledge and become proficient in dealing with cargo claims.
When cargo is damaged, the responsibility for the condition of the cargo is determined by the terms in the contracts signed and international conventions may limit or serve as defences for the carrier. Insurance also plays a large role but comes with its own set of rules and regulations.
The course will help you identify the potential challenges in advance in this complex environment and enable you to ask the right questions to the parties involved, thereby helping you to understand and explain your own risks and exposure.
After the course, you will have a have a much deeper understanding of the fundamental issues related to cargo claims, the flow of documentation and how risks can be mitigated. You will be able to discuss issues, such as dangerous cargoes, seaworthiness and defences, with your customers, colleagues, P&I club or legal counsel.
A 60 minute open book assessment is part of the course, the purpose is to ensure that the participants use information at their disposal to solve problems in a practical way. A BIMCO certificate will be issued.
BIMCO issues electronic course files as an Adobe PDF file enabling you to make personal notes using a computer or tablet. Please bring a computer or tablet! All documentation and presentations will be in English.
The fee includes coffee breaks, lunch and course materials, but not transport or accommodation, this should be arranged by the participant directly with the hotel.
